Are Your Part-Time Staff Entitled To Time Off In Lieu Of Bank Holidays?

By Petra Venton This month we look at a difficult area for employers what bank holidays are your part-time employees entitled to? With two bank holidays in May, the Employment Appeal Tribunals recent decision in McMenemy v Capita Business Services Limited will be of interest to employers of part-time staff. Four of the eight bank holidays always fall on a Monday (Easter Monday, May Day, Spring Bank Holiday and August Bank Holiday). One is always on a Friday (Good Friday) and the other three vary from year to year. There has been debate for some time about whether part time employees are eligible for pro-rata time off in lieu of bank holidays where they do not work on a Monday. The basis for this argument is the Part-Time Workers (Prevention of Less Favorable) Treatment Regulations 2000 that make it unlawful to treat a worker less favorably on grounds of his or her part-time status. In this case, Mr. McMenemy worked three days a week (Wednesday, Thursday and Friday). He claimed that he was being treated less favourably than full-time employees, as he did not get the benefit of bank holidays that fell on a Monday. Under his contract of employment, he was entitled to take paid leave on public holidays where they fell on one of his normal working days. His employers business operated 7 days a week. This meant that some full-time employees also did not work on Mondays. In fact, Mr. McMenemys line manager had worked a Tuesday to Saturday shift for some time. During this period, he did not get time off in lieu of bank holidays that fell on a Monday. The Employment Appeal Tribunal held that the reason that Mr. McMenemy did not get time off in lieu of bank holidays that fell on a Monday was not because he was part-time as full-time employees were treated in the same way. Rather, it was because he did not work on a Monday. Mr. McMenemy therefore lost his claim. This case is likely to be helpful to many employers in the retail, leisure and manufacturing sectors that operate on a 7-day week basis. However, where does it leave employers who operate 5 days a week from Monday to Friday? What are the options for employers who operate 5 days a week? Where an employer operates on a 5-day week basis (Monday to Friday), all full time employees will receive the benefit of bank holidays that fall on a Monday (assuming that their contracts of employment provide for this). A part-time employee who does not work on Mondays will benefit from a maximum of only four bank holidays a year (depending on what day Christmas falls). The Part-Time Workers (Prevention of Less Favorable Treatment) Regulations 2000 provide that part-time workers should have the same benefits as full-time workers on a pro rata basis. A full-time employee will get 8 days off for bank holidays. Therefore, a part-time employee who works say 3 days a week should get 5 days off in respect of bank holidays. As a maximum of only four bank holidays fall on the part-time employees working days, how should the employer make up the additional day(s)? The DTI Guidance on part-time working suggests that it may be necessary to remove the disadvantage suffered by those staff who do not receive particular days off as a result of their particular working pattern, for example, by giving all workers a pro rata entitlement to days off in lieu according to the number of hours they work. In our example above, this would mean giving the employee at least one additional day off in lieu of bank holidays. The difficulty with such a system is that it is complicated to administer and can have an adverse effect on part-time employees who do work on Mondays. If the part-time employee worked on Mondays, Wednesdays and Fridays, at least five bank holidays would fall on working days (all the Monday bank holidays and Good Friday). If Christmas Day and New Years Day also fell on a Monday, seven bank holidays would fall on working days. Under the pro-rata system suggested by the DTI, the employee would only be entitled to five days of bank holidays. What should the employer do about the other two bank holidays for which they would have been paid? There are two options. Either the employee would be required to use some contractual holiday entitlement to cover those days or alternatively be given the option of coming to work on a day they did not normally work. Neither of these options would be favored by employers or part-time employees, as they are difficult to administer and would not fit in with part time working arrangements. Many employers therefore simply give their part-time staff the benefit of bank holidays if they fall on one of their normal working days. This system clearly does not always give part-time staff the same benefits as full-time staff on a pro-rata basis. As such, it is unlawful discrimination, unless an employer can justify it. There is an argument that an employer could justify this system of restricting the benefit of time off for bank holidays to staff who actually work on those days on the basis that the time off relates to the days worked rather than the part-time status. However, this argument is untested. This issue may be resolved in the not too distant future as the Government proposed in its 2005 election manifesto that during their third term they would extend the entitlement to paid annual leave to include bank holidays. The Government has included an enabling power in the Work and Families Bill. This is subject to further consultation and is not expected to come into force until 2007 at the earliest. What is worth noting however is that the DTI make clear in their Guidance that if bank holidays are treated as additional leave on top of the statutory four weeks, the amount of time allocated to part-time staff will be calculated on a pro-rata basis. [1] Conventional Treatments Conventional treatments focus on stimulating drugs that are similar in structure to amphetamine (also known as speed), such as: Phentermine (Adipex, Fastin, Ionamin) Diethylpropion (Tenuate, Tepanil) Phendimetrazine (Adipost, Bontril, Plegine, Prelu-2) Benzphetamine (Didrex) Mazindol (Sanorex, Mazinor) is an isoindole thought to inhibit the reuptake of norepinephrine rather than to cause its release. The low-fat diet comes from this theory, since fats have the highest amount of calories by weight. Unfortunately, most low-fat foods are extremely high in carbohydrates. Carbohydrates (sugars) are quickly converted into glucose in the body, and are used for quick energy. Fats are used for long-term energy storage, and are the bodys second choice for energy. Protein is the bodys building block for muscle and is the third choice. High-protein diets are based on the theory that the body will burn carbohydrates and fats for energy before protein. Alternative Approaches Alternative approaches to weight loss, in general, focus on lowering dietary carbohydrates (instead of fats). Low carbohydrate diets are routinely recommended to control diabetes, and many consider obesity and overweight to be early forms of diabetes. In diabetes, the glucose (blood sugar) levels are highly elevated. In pre-diabetes, insulin is not as effective and higher levels are needed to maintain normal glucose levels. Metabolic Syndrome X Syndrome X refers specifically to a group of health problems that can include: Insulin resistance (the inability to properly deal with dietary carbohydrates and sugars), and type II diabetes Abnormal blood fats (such as elevated cholesterol and triglycerides), Overweight, especially abdominal obesity, and High blood pressure (hypertension). Metabolic syndrome X is caused by a diet high in simple carbohydrates, such as sugar, white flour, bread, pasta, donuts, cookies, candy, etc. Refined carbohydrates not only raise glucose and insulin to unhealthy levels, they also are devoid of vitamins, minerals, and nutrients our bodies need to properly utilize these foods. Chromium Chromium is required to break down the cellular insulin resistance that causes higher-than-normal blood sugar levels. Insulin resistance is a component of diabetes and Metabolic Syndrome X. Overweight people usually suffer from insulin impairment that prevents the proper cell uptake of carbohydrates (sugars). Excessive serum glucose is converted into body fat. Chromium has received widespread publicity for its ability to lower serum glucose levels by increasing insulin sensitivity. Studies have shown that chromium supplementation results in a slight reduction in body fat and an increase in lean body mass. In 1997, Austrian researchers conducted a study to assess the effects of chromium yeast and chromium picolinate on lean body mass during and after weight reduction with a very-low-calorie diet. Thirty-six obese non-diabetic patients undergoing an 8-week very-low-calorie diet followed by an 18-week maintenance period were evaluated. During the 26-week treatment period, subjects received either placebo or chromium yeast (200 mcg/day) or chromium picolinate (200 mcg/day) in a double-blind manner. After 26 weeks, chromium picolinatesupplemented subjects showed increased lean body mass. Researchers reported chromium picolinate, but not chromium yeast, is able to increase lean body mass in obese patients in the maintenance period after a very-low-calorie diet without counteracting the weight loss achieved. [2] Magnesium While chromium has received the most media attention, the scientific literature shows that magnesium plays an even more important role in regulating carbohydrate metabolism. About 80% of Americans are magnesium-deficient. When they go on a diet, they become severely deficient in magnesium, which causes the insulin resistance that contributes to the failure of the diet. Magnesium is involved in a number of enzymatic reactions required for cells to uptake and metabolize glucose. Magnesium deficiency causes insulin resistance and elevated blood sugar levels. [3-6] Vitamins B6, B12 and Chromium A recent study found that among overweight or obese men and women, long-term use of multivitamins, vitamins B6 and B12, and chromium were significantly associated with lower levels of weight gain. [7] The study used data from the VITamins And Lifestyle (VITAL) cohort study of western Washington. Participants (n =15,655) completed questionnaires about 10-year supplement use, diet, health habits, height, and present and former weights.The study defined high use as: Multivitamins > 5 pills/week, Vitamin B6 (Pyridoxine) > 35 mg/day, Vitamin B12 (Cobalamin) > 35 mcg/day, Chromium > 150 mcg/day Although there are no studies on vitamins B6 and B12 for weight loss, the authors proposed that their effect on glucose and energy metabolism explains these results. Vitamin B6 is a cofactor for glycogen phosphorylase, which breaks down glycogen (stored glucose) to form energy. Vitamin B12 is a cofactor of methylmalonyl CoA mutase, which converts methylmalonyl CoA to succinyl CoA, an intermediate in the Krebs cycle, the central energy production pathway in the body. I cannot tell you how many goals I have set in my lifetime, only to see the excitement and energy surrounding them fade away into the horizon. Once in a while, I would find my goal sheet lying around beneath a pile of disorganized papers, written out all nice & neat, with dates and everything. I could tell that I was excited when I wrote down those goals. Regardless of the excitement I may have felt at the time, somehow my focus and drive to achieve these goals got lost in the shuffle of things to do in life. You must go beyond merely setting goals; you must use your goals as a tool for success. Setting any goal and writing it down is the easy part, the challenging part, step two, is to focus on your goal and take action until you see your desired results. I’ve outlined some strategies that we’ll review over the next few days that you can use to set goals and see them realized in your life. Strategy # 1: Believe in your Dream Recently I was speaking to a friend about one of my goals. She said: “I know you can do it, you are so persistent and you are really talented”. I thought to myself: you know she is right, I can do this. But, in the next sentence she went on to describe to me why she couldn’t reach her goals, how it just won’t work for her, and how she just isn’t able to do it. In that moment I realized how easy it is to talk to believe in someone else when we don’t believe in ourselves. One of the saddest things I see in people who want to lose weight & get fit is that they do not believe in themselves. They just don’t think they can do it and they believe it so deeply that they don’t even set goals for themselves to reach. If you make the decision to lose weight, burn fat, or get fit, you must believe in yourself from the inside out. You must believe you can achieve the best, instead of condemning yourself to have the worst. I feel there are very few people who are incapable of having a great body, but there are many people who don’t believe in themselves enough to make it happen. Believe in yourself and your goals and you will see a whole new result! Strategy # 2: Set Long Term Goals The first type of goal you should set is your “ultimate goal”. Take a moment and imagine exactly what you would like to achieve. How do you want to look, what clothing size do you want to wear. Do you want to burn fat, compete in a race, or gain strength? Your ultimate goal should be just that, the ultimate things you would like to see happen with your health. Write down your top 10 ultimate goals being as specific as possible, and set a reasonable time frame. For example, if losing weight is your ultimate goal, set a challenging ultimate goal, but also consult your doctor or to find a healthy time frame to coincides with that number. You can also do research on the internet or purchase your own info products to help you gain an understanding of how the body works. I’ve heard this statement often, although I can’t remember who wrote it: “there are no unrealistic goals, just unrealistic timeframes” and I tend to agree with that statement. If you set an unrealistic timeframe for yourself, you’ll become really discouraged with the entire process and probably give up. Another important thing to remember about long term fitness or fat loss goals is that your high school body weight should not be the “gold standard”. In fact, body weight should not be your focus at all. If you really want to do it right, you should have your body fat % measured and use that in combination with your body weight to monitor your progress. Don’t get caught up with the numbers on the scale. Measuring body fat % is actually a far better indicator of the progress you make in your fitness program. Strategy # 3: Set Progressive Goals Now that you know your ultimate goal, you can use progressive goals as increments to measure your progress. If you’d like to lose a significant amount of weight or body fat, learn to pace yourself and do it one step at a time. Progressive goals will keep you motivated to continue toward your ultimate goal by breaking down the ultimate goal into reasonable chunks. They place your mental focus on incremental progress and eliminate the feeling of being overwhelmed by the ultimate goal. An example of a progressive goal is to lose 1 pound each week for the next year (that’s 52 lbs!). A goal like that makes the idea of losing 52 lbs. sound reasonable. Or, if you want to lose body fat, break it down into more manageable chunks, like 1% a month for the next 6 months. Have small goals you can reach every week. If you set a goal to workout 5 times per week, when the end of Tuesday arrives and you haven’t exercised at all, you’ll know you have to get moving. If you are new to fitness, it’s wise to set reasonable progressive goals, like walking 10 minutes a day for 5 days per week. As you become more fit, adjust your progressive goals to accommodate your new fitness level. Keep track of the progress you make toward your goals by keeping a journal or a spreadsheet on your computer. Tracking your behavior by writing it down will improve your success rate and reduce uncertainty. It allows you to review what you’ve done and see what is working and what isn’t. When you review what you’ve done, written down in your very own handwriting, it shows you exactly where you’re meeting your goals and where you need improvement. It’s really an eye opener when you actually follow through with writing things down…..try it and see! Strategy #4: Make an effort to note your progress Accomplishing a progressive goal is rewarding, each incremental step forward makes ultimate goals seem achievable. One way to motivate yourself to accomplish progressive goals is to mentally note any progress you have made toward them. Pat yourself on the back if you feel more energetic or have tightened your belt one more notch. Congratulate yourself for eating healthy & balanced meals for an entire day. Noting these little steps of progress feels good and motivates you to continue. Focusing on your progress is the exact mental attitude you need if you really want to reach your ultimate goals. If you have a critical personality or low self-esteem, it is very easy to focus on how fat you are and criticize yourself for not reaching weekly goals. As soon as you establish your ultimate & progressive goals, you must also learn to have a “progressive” attitude. Don’t waste your time on thoughts and emotions that tear you down. Your journal contains a record of all the areas you’ve improved and the areas where you still need work. Since the journal has a record, there is no reason for you to continually focus on all your short-comings. Spend your time coming up with creative solutions that will help you reach your progressive goals and focus on everything you are doing right. You may want to set up reward system for extra motivation for reaching certain a certain goal or making it through an entire week while meeting certain criteria. Treat yourself to a massage or a day at the spa and relish every moment of your success. Things like a chair massage, pedicure, manicure, or a visit to a favorite store can be the perfect motivation. Your rewards should reinforce your goals; things like massage and spa days are beneficial to your body and help you to feel good physically. Conversely, a reward such as eating a whole pizza or gallon of ice cream will only cause you to veer off the path to your ultimate goal. Strategy # 5: Be grateful for how far you’ve come Gratitude is a powerful emotion that super charges your brain for success. Research at U.C. Davis accredits gratitude with improved health, reduced stress, and a higher level of overall well-being. Emmons, University of California, Davis & Michael E. McCullough, University of Miami Synopsis. Gratitude is the “forgotten factor” in happiness research. We are engaged in a long-term research project designed to create and disseminate a large body of novel scientific data on the nature of gratitude, its causes, and its potential consequences for human health and well-being. Scientists are latecomers to the concept of gratitude. Religions and philosophies have long embraced gratitude as an indispensable manifestation of virtue, and an integral component of health, wholeness, and well-being. This project is supported by a grant from the John Templeton Foundation of Radnor, PA. Gratitude Interventions and Psychological and Physical Well-Being In an experimental comparison, those who kept gratitude journals on a weekly basis exercised more regularly, reported fewer physical symptoms, felt better about their lives as a whole, and were more optimistic about the upcoming week compared to those who recorded hassles or neutral life events (Emmons & McCullough, 2003). A related benefit was observed in the realm of personal goal attainment: Participants who kept gratitude lists were more likely to have made progress toward important personal goals (academic, interpersonal and health-based) over a two-month period compared to subjects in the other experimental conditions. A daily gratitude intervention (self-guided exercises) with young adults resulted in higher reported levels of the positive states of alertness, enthusiasm, determination, attentiveness and energy compared to a focus on hassles or a downward social comparison (ways in which participants thought they were better off than others). There was no difference in levels of unpleasant emotions reported in the three groups. Participants in the daily gratitude condition were more likely to report having helped someone with a personal problem or having offered emotional support to another, relative to the hassles or social comparison condition. In a sample of adults with neuromuscular disease, a 21-day gratitude intervention resulted in greater amounts of high energy positive moods, a greater sense of feeling connected to others, more optimistic ratings of one’s life, and better sleep duration and sleep quality, relative to a control group. This study is just the tip of the iceberg when it comes to the benefits you’ll receive from radiating gratitude for all that’s good in your life. Be grateful for the health you do have, for the activities you can do, and for all the times when your body was strong and capable. Some good statements to repeat daily are: I am grateful and pleased with how I look today. I feel thankful for all that I can already do, and for the things I plan to achieve. Make a gratitude journal and record ten things you are grateful for each day. You’ll be amazed at how your list grows and empowers you to succeed. You can focus on your fitness program, your health, reaching your goals, or whatever you feel thankful for that day. If you invest your time being grateful, you’ll be amazed at the return you receive and the goodness that spills over into every area of your life. Don’t overlook the power of gratitude! Strategy #6: Don’t give up Not everyone reaches their goals in the time frame they want. That doesn’t make giving up an option. It’s not called an “ultimate goal” for nothing. Your ultimate goal should challenge you like never before, and if you don’t make it right away, forgive yourself, pick yourself up and go at it again. If you really want to reach your ultimate goals, you must be willing to go through all the ups and downs that come with it. Sometimes it will be really difficult to continue forward, but once you reach the finish line, it will be worth it! Don’t Quit. Wagner Pain is not a pleasant thing to have to live with, but sometimes you have to stop and ask the drug companies if they can’t come up with a better way of managing pain, because what we have on the market today is just flat out killing us. Like they say, forewarned is forearmed. Celebrex is a member of a wide range of drugs called NSAIDs. In case you’re wondering what that stands for, it’s NonSteroidal Anti-Inflammatory Drugs. That’s how they came up with NSAIDs. What these drugs basically do is reduce inflammation. This can be inflammation from a variety of ailments such as arthritis and even menstrual pain. Doctors pretty much prescribe Celebrex for just about any pain that isn’t a common headache. This is another problem with the medical community. We hand out pain killers like they were gum drops. You can thank the drug companies for that. But that’s another subject altogether, so don’t get me started. Fortunately, your doctor will tell you not to take Celebrex if you suffer from heart problems or if you’ve had a heart attack or stroke. You’ll also be told to avoid taking Celebrex if you’ve had a history of ulcers or stomach bleeding. Other factors that will put you at risk if you take Celebrex are history of liver problems, kidney problems. asthma, or any kind of blood clotting problem. So, just what are the possible side effects of taking Celebrex? Well, on the more mild side, you can suffer from an upset stomach, mild heart burn, constipation, gas, dizziness, headache and some blurred vision. This drug can also make you extremely nervous. When I used to take Vioxx for a muscle pull, I almost had a panic attack the first night. I immediately stopped taking it. Now I am quite glad I did. But what about the really harmful side effects? Well, at worst, Celebrex can increase your risk of a life threatening heart attack or stroke. I guess the rest of the possible serious problems really don’t matter much when taking this drug can basically kill you outright. If I sound angry, cold or just plain fed up, it’s because I have personally seen loved ones die because of Celebrex and drugs like them. The doctors claim that these drugs do more harm than good. I’m not so convinced. However, now that you know the facts of Celebrex, you can make up your own mind as to whether or not you want to risk your life taking this medication. Someday the medical profession will get it right. They just haven’t yet.
